Terms

These terms are an agreement between you and Daily Gym ("we", "us"), a small independent game run from British Columbia, Canada. By using the site, you agree to them. If you don't agree, please don't use Daily Gym.

0. Who can play

• You must be 13 or older to play.
• To buy anything (Pro, a plan or a sponsor day) you must be an adult where you live (19 in British Columbia), or have a parent or guardian buy it for you.

1. Your health comes first

• Daily Gym is a game, not medical or fitness advice. You exercise at your own risk.
• Check with a doctor before starting if you have a health condition, an injury, are pregnant, or haven't exercised in a while.
• Stop right away if you feel pain, dizziness, shortness of breath or anything unusual.
• Clear the space around you, use a stable surface, and put your phone somewhere it can't fall or be stepped on.
• The counter is good but not perfect. It can miss or miscount reps.

2. Playing fair

• You get one official try per day. Play only as yourself, on your own phone.
• No cheating: no videos or photos in front of the camera, no bots, no playing under several names, no messing with the site.
• Names must not be rude, hateful, or pretend to be someone else. We may rename players.
• We may remove scores, players or competitions that break these rules, without notice.

3. Running a competition

• You're responsible for your competition: its name, who you invite, and anything you promise people.
• Prizes are yours, not ours. If you offer a prize, you deliver it and follow your local rules for prizes and contests. We don't hold, judge or guarantee prizes.
• Don't charge players entry fees for cash prizes or use competitions for betting. Daily Gym doesn't handle money between players.
• Don't put anything in your logo, name or welcome line that you don't have the right to use.

4. Sponsoring and rewards

• One brand per day. Your brand shows to every player, in every country, on the days you book. Nobody else can sponsor those days.
• What we don't show: alcohol, tobacco or vaping, gambling or betting, adult content, weapons, political or religious campaigns, unproven health or weight-loss claims, anything misleading or illegal. We may turn down any booking, and if we do, you get a full refund.
• You must have the right to use your brand name, link and message.
• Rewards are your promise. If you offer a reward, you honour it for every player who unlocks it while the code is valid.
• Player numbers we show are estimates from recent days. We can't guarantee how many people will play on your day.
• Refunds: cancel at least 48 hours before your first day for a full refund. Once your first day has started, it isn't refundable. If we can't run your days, you get a refund for the days we missed.

5. Paid plans for organizers

• Event and Big Event are one-time payments for one competition. Ask within 7 days of paying, and before the competition starts, for a full refund.
• Club is $99 a month for one always-on competition (like your gym's league), up to 500 people. It renews every month until you cancel. Write to us to cancel: cancelling stops the next payment, and you keep Club until the end of the month you paid for.
• We may change prices for future periods. If you're on Club, we'll tell you before your price changes.

6. Pro

• Price: $4.99 a month or $39.99 a year, in US dollars (your bank may add currency fees). Taxes may be added where the law requires.
• It renews by itself at the same price every month or year until you cancel. We'll tell you before a price change, and the change only applies from your next renewal.
• Cancel any time from the "Manage or cancel" button on the Pro page, or by writing to us. You keep Pro until the end of the time you've paid for. We don't refund part-used months or years, except where the law says we must.
• Day 1 of every program is free, so you can try before you pay.
• Pro is tied to your phone's browser. After paying you get a Pro code: type it on a new phone to move Pro there. Keep it private.
• Before card payments open, the Pro button may take your email instead. Joining that list is free and commits you to nothing.

7. Sponsors and ads

Daily Gym is kept free by daily sponsors. Ads from other companies are off right now; if we turn them on, free players may see them. We aren't responsible for what other companies advertise, and we try to keep out the kinds we don't allow from sponsors.

8. What you give us

Your player name, team names, competition details and brand content stay yours. You let us show them inside Daily Gym (on boards, competition pages and share pictures) for as long as they're part of the game. Videos you make and share from your phone are entirely yours.

If you're the day's top player, you also let us use your player name, country flag, score and the drawn replay figure in short videos and posts about Daily Gym on our own social media accounts. These never show you or your camera. Ask us and we'll leave you out and remove past posts.

9. The service

• We work hard to keep Daily Gym running, but it's provided "as is". It may sometimes be down, slow or have bugs, and we may change or stop features.
• To the extent the law allows, we aren't responsible for indirect losses, and our total responsibility to you is limited to what you paid us in the 12 months before the problem (or $50 if you paid nothing).
• Nothing here takes away rights you have by law as a consumer.

10. Ending

You can stop using Daily Gym at any time and ask us to delete your data (see Privacy). We may suspend people who break these terms.

11. The law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. If something in them can't be enforced, the rest still applies.

12. Changes and contact

If we change these terms, we'll update the date at the top. If a change is big, we'll say so on the site.
